(Chuck Muth) – Republicans in the Nevada State Assembly continue to stir a cauldron of chaos over leadership decisions for the 2021 session.

Minority Leader Robin Titus made a “deal with the devil” and surrounded herself with three RINOs (Republican in Name Only) – Jill Tolles, Tom Roberts and Glen Leavitt – in the assistant leader and whip positions despite the fact that her new members have moved the caucus decidedly to the conservative right.

The conservative freeze-out continued Monday when it was announced that Titus had tapped the three RINOs, plus a pair of RINO enablers, to serve on the powerful Ways & Means Committee even though none have any experience on Ways & Means whatsoever.

On the other hand, Titus chose NOT to appoint returning conservative Assemblywoman Jill Dickman to the committee even though she had experience serving on it during the 2015 session.  Talk about an insult.

And then there’s this…

Last March 18 – the day after Gov. Sisolak ordered his first statewide shutdown – Assemblyman Jim Wheeler submitted a “Bill Draft Request” (BDR) that “Limits the duration of a state of emergency or declaration of disaster declared by the Governor.”

Wheeler’s LEAP (Limiting Emergency Actions & Powers) Act would require governors to seek legislative approval to continue issuing executive orders beyond a set time period.  It makes all the sense in the world and is desperately needed in Nevada.

Fast-forward to this past Monday.

Assemblyman Wheeler – in response to Gov. Sisolak’s Sunday declaration of ridiculous new COVID-related restrictions, including mandatory masks in your own home and limits on Thanksgiving dinners – issued a press release in opposition to the new dictatorial edicts…

“I have introduced a bill that will limit this Governor’s, and future Governor’s, emergency powers to 15 days without approval of the Legislature and that all directives given under those powers also be approved by the legislature.

“My goal in pushing this bill is simple: If the Governor believes that it’s necessary for him to continue to exercise emergency powers, then he should not be allowed to simply do so unilaterally and with no oversight.

“He should have to come before lawmakers, make his case, and then let the people’s representatives decide whether his emergency powers and edicts are to be extended. … We deserve a voice.  The people of Nevada deserve a voice.”

Indeed.  Now get this…

The very next day, the Republican Assembly Caucus issued a rare press statement in which Titus declared caucus support for “the efforts of our Republican colleagues to rein in the governor’s emergency powers.”

Interesting that she chose not to give specific credit where credit is due by recognizing, by name, Assemblyman Wheeler’s early leadership on the issue.  Adding insult to injury, the release includes a quote by a new caucus member rather than from Wheeler, the actual sponsor of the BDR.

The hostility and animosity by Titus towards Wheeler – who Titus successfully ousted as Minority Leader with support from the RINOs at the end of the 2019 session – is palpable.  And it doesn’t help that the pair are expected to face off in a GOP primary for term-limited Sen. James Settelmeyer’s seat in 2022.

So expect the bad blood between the two to continue percolating throughout the 2021 session.

Meanwhile, the teacher’s union has gathered enough signatures to put two massive tax hikes in front of the Legislature when it convenes next February.  To date, only GOP Assemblywoman Black has publicly announced her “No” vote on those tax hikes.

Where’s the caucus press release announcing that all 15 GOP caucus members were joining Ms. Black in opposition?  After all, if they all declare their united opposition, Democrats won’t have the 2/3 super-majority they need to stick you and me with those tax hikes.  They’ll be DOA (dead on arrival).

Could it be there are members of the caucus who are OPEN to voting for higher taxes?

Bet on it.

If this was a horse race, the Republican Assembly Caucus would be the horse that stumbles out of the gate and crashes into the ground – hooves, dirt and jockey flying in the air.

In other words, the more things change, the more they stay the same.  How embarrassing.

UPDATE: ConservaCruise

Carnival Cruise Lines has announced that it’s delaying the restart of sailings until at least February, and maybe March.  This remains a very fluid situation, so we’re not making any plans for the 2021 Citizen Outreach cruise to Mexico just yet.

(Chuck Muth) – All the post-election “fraud” drama in Clark County isn’t just about Donald Trump.   And it isn’t about Stavros Anthony.  And it isn’t about April Becker.  And it isn’t about a dozen or so close local and judicial races.

It’s about Nevada’s election system itself.

And all these investigations and court challenges are absolutely necessary to fix the very real flaws currently built into the balloting system – which are legitimately calling the current election into question – and fixing them before the next one.

That’s not “voter suppression.”  That’s “election integrity.”

And there are three main threats to election integrity that need to be exposed and neutralized before 2022.  They are…

1.)  Universal Mail Balloting

The biggest problem with 2020’s universal mail-in balloting in Nevada wasn’t so much the fact that we automatically mailed ballots to people who didn’t request them – though that was, indeed, a problem.

The bigger problem was that ballots were mailed to people who never should have been mailed a ballot in the first place.

  • Yes, that includes dead people
  • Yes, that includes people who no longer live in the districts, let alone the state, where they’re registered
  • Yes, that includes voters who should have been put on “inactive” status but weren’t

Before universal mail-in balloting, the problem of dead people voting was minimized.  Dead people tend not to request absentee ballots or show up at the polls in person.  But when you mail an actual ballot to a deceased person, you’re asking for trouble.

It’s like leaving a cookie out on the kitchen table in a house full of dogs while you go to work. The temptation is just too big…especially when it’s so unlikely that anyone will be caught, let alone prosecuted beyond a reasonable doubt.

The second problem is people moving without changing their address with the election department.

If someone moves from District “X” to District “Y,” they shouldn’t be allowed to vote in District “X.”  We don’t allow candidates to run in districts where they don’t live.  Why should we allow voters to vote in districts in which they don’t live?

Indeed, NRS 293.1755 specifically requires that candidates “actually, as opposed to constructively, reside in the State, district, county, township or other area prescribed by law to which the office pertains.”

“Actually” means…well, actually.  And it makes sense.  Why should people who don’t live in the district be allowed to vote for the person who will represent the people who ACTUALLY live in the district?

And that especially pertains to people don’t even live in the STATE – with the limited exceptions of military personnel, certain government workers, students, and individuals who are living and working elsewhere temporarily.

What we need now is clarification of the definition of “temporary.”

Lastly, and perhaps most importantly, people who have had their voting status changed from “active” to “inactive” shouldn’t automatically be mailed a ballot.  That’s another dog/cookie recipe for disaster.

A voter is put on inactive status when the Election Department has reason to believe a voter no longer lives at the address where they are registered to vote.  This usually occurs when voters are mailed a notice from the Election Department and the post office returns it as “undeliverable.”

NRS specifically states that “The county clerk must not mail an absent ballot” if a previously mailed absent ballot “is returned to the county clerk as undeliverable.”

The Clark County Registrar of Voters failed to observe this prohibition in the 2020 general election by mailing thousands of ballots to people whose ballots in the primary election were returned by the post office as undeliverable.

That doesn’t mean they can’t vote.  It just means the voter has to confirm their address and eligibility to vote before casting a ballot.

And again, that’s not “voter suppression.”  That’s just the rule.  A rule the Registrar failed to follow.

2.)  Signature Verification

As a reminder, Nevadans have ALWAYS had the option to vote by mail, even before COVID hit.  They simply requested that an absentee ballot be mailed to them. In fact, 78,602 Nevadans voted by mail in the 2016 presidential election.

So there was no “safety” reason caused by COVID to justify mailing official ballots to every voter in the November election.  At best, the election departments could have and should have simply mailed an absentee ballot REQUEST to every voter and let the voter decide how they wanted to vote.

Instead, almost two million official ballots were mailed to a decidedly flawed list that included tens of thousands of voters who never should have been mailed a ballot in the first place.  As a result, 671,899 ballots were cast by mail in the 2020 election – almost a 10x increase over 2016.

And because so many ballots were mailed to bad addresses, the potential for illegally cast ballots exploded.  Which brings us to signature verification.

The only way to know if the legal voter actually cast their mail-in ballot is to compare the signature on the outside of the ballot envelope to the signature the election department has on file.  And that’s where the problems came in.

While Section 22 of AB4 allows county clerks to “authorize mail ballots to be processed and counted by electronic means,” only Clark County used a machine and computer software to do this.

Not coincidentally, almost all of the problems, questions and concerns about signature verification are coming out of Clark County.

So this issue MUST be addressed.

3.)  “Meaningful” Observation

There’s a reason burglars prefer not to rob homes and businesses that have dogs.  Dogs make it harder to steal.

That’s why independent election observers – watchdogs, if you will – are CRITICAL to ensuring election integrity at both the ballot box and the counting room.

Not outside the building.  Or 60 feet away with a pair of binoculars.  Or even six feet away.

Observers MUST be able to see exactly what the poll worker, the ballot counter and the signature verification adjudicators see.  Observers MUST be allowed to look right over the shoulders of election workers.

Otherwise, the observation simply isn’t “meaningful.”

Whether signature verification is done by machine or human being – or some combination of both – independent observers must be allowed to look at the signatures being matched and object if they disagree with the matching decision by election workers.

Not AFTER the mail-in ballots have already been separated from the mail-in envelopes bearing the voter’s signature.

BEFORE the ballot is removed from the envelope.

If there’s nothing to hide, there’s no reason not to do this.  But if there IS something to hide, you can bet those trying to hide it will scream the loudest about allowing for true, meaningful observation.

Even the liberal Las Vegas Sun, in an editorial last week opposing a new election in the Clark County Commission District C race, acknowledged that “there were some iffy ballots found” in the original election and concluded: “Yes, there needs to be more scrutiny.”

One more to wrap up

We DESPERATELY need a photo ID requirement for voting.

So let it be written; so let it be done.

“All evidence shows that Nevada’s election was fair, safe, and secure, and time and again, the Court has agreed.”

First, Mr. Ford needs to understand that the legal challenges are a nine-inning game and it ain’t over ‘til it’s over.  And it ain’t over.

Secondly… “all evidence”?  Not even remotely true.  Consider…

On Monday, November 16, the seven members of the Clark County Commission met to certify the election results…which they did.  EXCEPT for the County Commission District C race.

That race was “won” by Democrat Ross Miller over Republican Stavros Anthony by 10 votes out of over 150,000 cast in the initial count.  But then the EVIDENCE that the race was NOT “fair, safe and secure” emerged.

That evidence wasn’t provided by the Trump campaign or conspiratorial rightwing activists, but from the actual Clark County Registrar of Voters himself, Joe Gloria.

Mr. Gloria reported to the Commission that his office had identified 936 county-wide “discrepancies that we can’t explain” in the counting; the vast majority of which, 710, came from mail-in ballots.

That 76% of self-reported discrepancies by the Registrar’s office came from mail-in ballots is, you know, “evidence” that the quickly-ordered all-mail balloting posed significantly more problems than traditional in-person voting.

Again, that’s not according to the Trump campaign or right-wing conspiracy theorists; it’s from the county’s top election official.

The Registrar’s office also self-reported that “Six voters have been identified who voted twice in this election.”

So much for pre-election assurances that safeguards were in place to prevent that from happening.

Mr. Gloria proceeded to note that in the 2016 presidential election – which was NOT an all-mail election – only four discrepancies were identified by his office.  But in the 2020 election they discovered 936 – a staggering increase of over 23,000%!

And that’s NOT a fatally flawed election?

The discrepancies, according to Mr. Gloria, “represent issues related to tracking the process of ballots, moving from signature verification to manual signature verification, the ballot cure process, and counting board process.”

In other words, the hastily-ordered all-mail election – approved last August by the Democrat-controlled Legislature less than 100 days before the election – was deeply flawed.  Once again, not according to Trump supporters or rightwing conspiracy theorists, but by the Registrar of Voters himself.

That’s “evidence” that the 2020 election was anything but “fair, safe and secure.”

But wait.  It gets worse…

Mr. Gloria went on to note that 2,243 “provisional” ballots were rejected, including “115 (that) had already voted in the election, 142 (that) voted in the wrong district or precinct, 8 (that) were not eligible to vote, 1,925 (that) were not registered to vote, and 53 (that) did not provide adequate proof of residence or identification.”

In other words, the system was broken.

That the Registrar’s office caught these irregularities doesn’t change the fact that they occurred.  And how many more examples are out there that election officials missed or ignored?

In trying to explain the discrepancies that Mr. Gloria said couldn’t be explained, Mary-Ann Miller of the District Attorney’s office testified that…

“If somebody fails to actually sign in, but is then led to a voter machine and votes, then that precinct is going to be off by one vote.”

Wait.  If someone fails to check in and have their signature verified by a poll worker before being given their voting card to access the machine, how did they VOTE?  Sounds to me like another serious flaw in the security process.

Mr. Gloria went on to note that his office had identified 139 “discrepancies that we can’t explain” in the Commission C race that was decided by 10 votes.

“I don’t think,” Ms. Miller informed commissioners, “because of the nature of the discrepancies, that any court presented with these discrepancies would be comfortable saying that the results really reflect the will of the voters in Commission C.”

Gee, ya think?

Continuing, Ms. Miller informed commissioners that “you do have authority to declare that there’s enough concerns about an election in a particular race that you won’t certify the results…”

Which the Commission did by a vote of 6-1, with Commissioner Justin Jones being the lone dissent.

Commissioner Jim Gibson, a decided voice of reason during the hearing, said “it’s disappointing that there have been things like the ones that are described,” adding, “I imagine there are other things that have happened.”

Exactly.

What we know right now is only what the election department has self-reported.  We haven’t even gotten to the issues of…

  • The Registrar reportedly mailing tens of thousands of general election ballots to voters who had their ballots returned by the post office as “undeliverable” in the primary
  • Ballots illegally cast by dead people
  • Ballots potentially cast illegally by voters who moved out of state for reasons other than being in the military or as students
  • Ballots that were counted in which signatures arguably didn’t match

There’s more than enough evidence – as presented by the Registrar and the District Attorney’s office, not rightwing conspiracy theorists – to call into question the integrity of the Clark County election system in 2020.

As such, a judge should order a complete and thorough audit of the ballots, including an independent review of every mail-in ballot/envelope, to assess the accuracy of the signature verification determinations.

Additionally, Mr. Gloria should be compelled to provide full and transparent access to those envelope signatures and testify, under oath, about the entire election process and how it was handled or mishandled by his office.

Not just for Donald Trump.  Or for Stavros Anthony.  Or for the other races in Clark County, especially those that were decided by close margins this year.

But for FUTURE elections.

Nevadans should never be subjected to another election without sufficient procedural safeguards to protect against the blizzard of “discrepancies that we can’t explain,” as well as other administrative irregularities.

It’s not so much that this election was fraud as it was flawed.  Irreconcilably.  As such, no one can be sure the true will of the voters is reflected in the reported results.  The courts need to step in and fix this – even if it means all new elections.

So let it be written; so let it be done.

(Chuck Muth) – On Friday, members of the Republican Assembly Caucus – which picked up three seats in the 2020 election – cloistered themselves behind closed doors and re-installed the same failed “leadership” team that’s been at the helm for the last year and a half – and expanded it.

Here’s the low-down (you won’t read about this anywhere else)…

Contrary to the claim made in the caucus’ press release Friday night, Minority Leader Robin Titus was NOT “unanimously re-elected.”  There was no election.

A couple of wishy-washy conservatives in the sharply divided caucus sided with Team RINO (Republican in Name Only) and the votes simply weren’t there.  So no one challenged her.

But make no mistake, Titus’ support within the Train-Wreck Caucus was anything but “unanimous.”  Had there been an actual election, Titus and Team RINO were probably looking at an 8-8 tie if Assemblywoman Lisa Krasner had sided with the conservatives.

But she didn’t.

Give Dr. Titus credit.  She successfully played the political let’s-make-a-deal game by creating out of whole cloth two new, previously non-existent “Assistant Whip” leadership positions and gave one to Krasner in return for Krasner’s support.

That move gave Titus a likely 9-7 advantage – which is why no one challenged her for the Minority Leader position.

Shame on Ms. Krasner.  This is exactly the kind of unprincipled you-scratch-my-back-I’ll-scratch-yours that was pulled by former sell-out Assemblymen John Hambrick and Chris Edwards before the start of the disastrous 2015 session.

Conservatives need to remember this in the 2022 PRIMARY when Ms. Krasner either runs for re-election or tries to move up to the state Senate.

The really sad thing is, had Dr. Titus acknowledged the decidedly rightward post-election shift of her caucus membership, she would have gotten far bigger majority support…likely 11 to 5 or maybe even 13 to 3…to bring in new, stronger, more-principled conservative leadership to her caucus.

Indeed, to his credit, Assemblyman Jim Wheeler offered to support Titus and not run against her in the 2022 GOP primary for termed-out State Sen. James Settelmeyer’s seat if she would make changes to her leadership team.

Wheeler and Assemblyman John Ellison – the longest-serving member of the caucus – could have and should have gotten the Assistant Leadership positions.

And the Whip position could have and should have gone to any number of conservatives – including, possibly, either of the two returning conservative members: Jill Dickman or Richard McArthur.

Or maybe even incoming freshman Andy Matthews.

Matthews is (a) from the south, if you want some regional balance in the leadership positions, (b) has the biggest, deepest conservative policy chops or any member in the caucus, and (c) when all is said and done will likely report at the end of the year raising almost $400,000 for his race.

How do you NOT put someone like that in a leadership position of some kind?

Unfortunately, Dr. Titus rejected Assemblyman Wheeler’s selfless offer and decided to stick with the RINO’s instead of bringing in new, conservative blood.

Worse, she expanded the size of her train-wreck leadership team from three RINOs to five; not one movement conservative among them.

Which brings up another BS “spin” claim made in Friday’s press release and subsequent media reports.  Consider this from the Las Vegas Review-Journal on Sunday…

“For Republicans, the gains in the Assembly were a payoff from a more narrow and focused approach than in years past, an effort spearheaded in large part by Assemblyman Tom Roberts, R-Las Vegas, and Assemblywoman Jill Tolles, R-Reno. They focused on only the seats that had voter registration margins within 5 percentage points, which were Districts 2, 4, 29, 31 and 37. Republicans won all but one of those races…”

Oh, puh-lease. The caucus ALWAYS narrows and focuses its efforts on potentially winnable seats in swing districts.  That’s nothing new.  The idea that Roberts and Tolles deployed some genius new strategy in this election is absurd.

But the claim of brilliant “strategery” is even more preposterous than that…

Assembly Republicans picked up three seats: Former Assemblywoman Jill Dickman (AD31), former Assemblyman Richard McArthur (AD4) and Andy Matthews (AD37).  But guess what?

The caucus did NOT support any of those three conservatives in their GOP primaries!

In fact, the three conservatives won DESPITE Team RINO, not because of them.  The Republican Assembly Caucus had virtually NOTHING to do with their victories in the general election.  The conservatives prevailed all on their own.

And while Republicans may now be out of the super-minority, don’t let that fool you.  Republicans had the MAJORITY in 2015 – and proceeded to pass the largest tax hike in state history.

When tax hikes come up in the 2021 session, Democrats will need two GOP votes in the Assembly to meet the 2/3 majority required, as well as the illusion of “bi-partisan” support.  Don’t be surprised when the RINOs sell us out again and give it to them.

Combine that with the fact that the same incompetent caucus staff will be at their desks in Carson City for the 2021 session, and conservatives can expect yet ANOTHER session disaster that could easily put Republicans back in the super-minority in 2022.

(Chuck Muth) – When the vote-counting smoke cleared yesterday, our friend and fellow Republican Stavros Anthony ended up 10 votes short in his Clark County Commission race against Democrat Ross Miller – out of over 153,000 cast.

Expect a call for a recount.  But there’s a problem.  According to NRS 293.404…

“The recount must include a count and inspection of all ballots, including rejected ballots, and must determine whether all ballots are marked as required by law. All ballots must be recounted in the same manner in which the ballots were originally tabulated.”

The key word here is “inspection.”

Rejected ballots will include mail-in ballots in which the signature on the ballot envelope didn’t match the signature on file with the election department.  How many were rejected that shouldn’t have been?  How many were accepted that shouldn’t have been?

We also know of at least one dead person who has been confirmed to have voted by mail-in ballot and hundreds, if not thousands, of ballots that were cast by people who no longer live in Nevada.

“With Nevada’s transient population,” the Las Vegas Review-Journal reported on Thursday, “it is difficult for election officials to keep a clean voter roll of only voters who are active and living in the state.”

Which is another reason that automatically mailing ballots to people who didn’t request them was the height of stupidity – unless, of course, your intent was to cheat and steal an election.

And the reality is, it really wasn’t all that hard to significantly clean up the voter rolls.

According to a report by the Public Interest Legal Foundation (PILF) back in August, 93,585 ballots mailed to ACTIVE voters in the June 2020 primary were returned by the post office as “undeliverable.”

Those “undeliverable” primary voters – unless they updated their address with the Election Department – should have been removed from the list of voters who were automatically mailed a ballot by Clark County for the general election.

But they weren’t.  That’s malfeasance on a grand scale.

“These numbers show how vote by mail fails,” PILF President and General Counsel J. Christian Adams said.  “New proponents of mail balloting don’t often understand how it actually works.

“States like Oregon and Washington spent many years building their mail voting systems and are notably aggressive with voter list maintenance efforts. Pride in their own systems does not somehow transfer across state lines. Nevada, New York, and others are not and will not be ready for November.”

Indeed, we weren’t.

Rebecca Gill, an associate political science (ugh) professor at UNLV, countered concerns and warnings by telling the RJ “that election officials could have cleaned up the voter rolls but that risked disenfranchising legitimate voters who needed to vote safely during the (coronavirus) pandemic.”

Sheep dip.

Every legitimate voter who had a concern about voting in person due to COVID-19 could have requested an absentee mail-in ballot – an option Nevada voters have always had.  There was simply NO safety reason to automatically mail ballots to people who didn’t ask for them, who no longer live at the address where they’re registered or were…well, dead.

The RJ also reported on Thursday that Clark County election officials “have said that there are legitimate explanations for out-of-state people voting in Nevada if they are military families or students who go to school outside Nevada.”

Fine.  But what if they aren’t?

Did more than ten non-Nevadans vote in Stavros’ election illegally?  Were any mail-in ballots, many of which never should have been mailed in the first place, intercepted and/or voted by someone else?

The only way to know is if you closely inspect the signatures on the ballot envelopes in a recount to see if questionable ballots were approved by the signature verification machine that had its verification criteria lowered unilaterally by the Registrar of Voters to 40 percent for the general election.

However…

During the counting process the ballots were separated from their return envelopes.  So during the inspection process of a possible recount, there’s no way to know which ballots should be rejected for any number of reasons in this totally fouled up election.

To repeat:

“All ballots must be recounted in the same manner in which the ballots were originally tabulated.”

The mail-in ballots were “originally tabulated” by first inspecting and verifying the signatures on the ballot envelope.  And since that can no longer be done, there’s no way to conduct a lawful recount.

The only remedy is to hold a new election.

And that goes for a dozen or so other close races in Clark County – including the Senate District 6 race, a State Board of Education race, a University Regent race and two Family Court races that were decided by a margin of less than 1 percent.

And even Question 1 which lost by 1/3 of 1 percent.

In fact, the Clark County Election Department so royally screwed up this entire process on so many fronts that the only remedy to assure the true will of the people and the integrity of the results is to take a mulligan and call for an entire new special election for all 100+ races.

With NO automatic mailing of ballots to everyone on the county’s decidedly unclean voting roll this time around.

So let it be written; so let it be done.

(Chuck Muth) – In a comprehensive story in Thursday’s Las Vegas Review-Journal, Art Kane reports on “an allegation that a ballot in Rosemarie Hartle’s name and with her signature was voted” in Nevada’s 2020 general election.

One problem: Mrs. Hartle has been dead since 2017.

And here’s an even bigger problem as reported by Mr. Kane…

“Clark County elections officials said they verified that Rosemarie Hartle’s signature matched on the ballot.”

HELLO?!!

If the election department “verified” the signature on the outside of a ballot envelope matched the signature of a woman who has been deceased for three years, what does that say about the signature verification process being used to process over 400,000 mail-in ballots?

And there are certainly a LOT of reasons to further examine that verification process.

To start with, unlike the rest of Nevada’s counties, Clark County is using an optical verification machine that scans the signature on the outside of ballot envelopes and compares it to the signature on file with election department.

But as we’ve learned, the Election Department lowered the threshold to approve a signature match to 40 percent.  In addition, I’ve heard allegations that setting the criteria to 40% was below the manufacturer’s recommendation, but haven’t yet seen any verification of that claim.

If the verification machine/software “red flags” an envelope signature as possibly not matching the voter’s signature on file, then two election officials – “adjudicators” – must manually inspect the signatures, which is nothing more than a subjective opinion even if they are fully trained handwriting analysts.

If they both agree it’s a match, the ballot is counted.

But again, either the machine and/or two human beings looked at the deceased Mrs. Hartle’s signature and decided it was a match.  That’s a big red flag that something stinks in Denmark.

And then there’s this…

Las Vegas Review-Journal columnist Victor Joeck’s reported this morning that he had nine voters legally sign their mail-in ballot, but not in their OWN handwriting.  Instead, they imitated their signatures to generally look like Victor’s handwriting.  And guess what?

“Eight of the nine ballots went through,” Victor reported.  “In other words, signature verification had an 89 percent failure rate in catching mismatched signatures.”

“It’s unclear how much voter fraud took place in Nevada,” Victor concluded.  “But it’s clear signature verification isn’t the fail-safe security check elections officials made it out to be.”

Hoo-boy.

And while I don’t have first-hand knowledge of these incidences, I do know what happened to me on Election Day.

I showed up to vote in person.  I didn’t trust giving my unsolicited mail-in ballot to the poll workers, so they had me sign a release on a tablet using a sponge-tipped pen.  After signing it I told the poll worker that it didn’t look anything at all like my real signature.

The poll worker then compared my sponge-tipped signature on the tablet to the signature on file he pulled up on his computer, told me it was “close enough” – and gave me my ballot card!

I would bet the farm that this person was not a professional handwriting analyst.  And the fact that he deemed my mismatched signatures as “close enough” doesn’t exactly give me a bunch of warm-and-fuzzies about the entire signature verification system.

But, hey, don’t take any of our words for it. Seeing is believing, right?  And here’s an example demonstrating what I’m talking about.

The first photograph below is of Bruce Becker’s signature that’s on file with the Election Department.  The second photo is his signature on the outside of his ballot envelope.

Now, you tell me those signatures match!

Seriously, I don’t know how an optical scan machine, let alone two supposedly TRAINED handwriting adjudicators could possibly have come to the conclusion that these two signatures were “close enough.”

And yes, Mr. Becker’s mail-in ballot has been reported as received and tallied.

Obviously, this isn’t evidence of an illegally cast ballot.  But it IS evidence that the vote counting system in place for the 2020 general election in Clark County was DEEPLY flawed and wide open to ballot fraud.

Now…

Had INDEPENDENT observers been allowed to, well, OBSERVE the two adjudicators coming their conclusions when reviewing a possible signature mismatch, that would have been a vital security precaution that would have protected the integrity of the election.

But they weren’t.

At least not throughout the entire verification process and ballot counting.  And not from a distance close enough to actually see exactly what the adjudicators were seeing.  Why not?  After all, if there’s nothing to hide…why hide it?

For those who continue to claim that those calling into question how this entire election was handled are nothing but “conspiracy nuts,” they should have no problem with the Clark County Election Department conducting a new visual – not machine – audit of all 400,000+ mail-in ballots to confirm signature matching.

WITH INDEPENDENT OBSERVERS LOOKING RIGHT OVER THEIR SHOULDERS.

And if the Election Department won’t do this on its own, a judge should order it.

So let it be written; so let it be done.

(Chuck Muth) – The lead story in today’s Las Vegas Review-Journal is headlined: “GOP Claims Misfire: Detailed Evidence of Voting Irregularities Lacking.”  It’s actually a well-done, comprehensive report, but let’s take a look at it…

First, the absence of proof is not proof of absence.

Just because those currently investigating the systemic voting irregularities of Clark County’s 2020 election haven’t provided the public or the media its evidence doesn’t mean they don’t have any.

Whatever evidence they might have will be presented to the courts in various lawsuits that can’t be filed until after the ballot-counting is over…which is today.

On the other hand, as Tom Cruise said in A Few Good Men, “It doesn’t matter what I believe. It only matters what I can prove.”

Unfortunately, some people on the right continue to make wild allegations without not only presenting any proof, but without presenting even a reasonable suspicion that proof might exist.  Here’s an example…

A certain rather irresponsible blogger claimed on Wednesday that “140K Non-Citizens Received Mail-In Ballots.” But even his own numbers, let alone his assumptions don’t add up.

“According to Clark County Officials, only 30 non-citizens were removed from the voter rolls in 2019,” Rob Lauer wrote.  “That means at some 140,000 non-citizens received mail-in-ballots in this year’s presidential election.”

No, it doesn’t mean that at all.

His “proof” is supposedly that some 77,000 people in Nevada have been issued green cards since 2013 and another 63,000 have been issued Driver Authorization Cards.  But here’s the thing…

The fact that someone was issued a green card or driver authorization card doesn’t prove they were mailed a general election ballot.  In addition, many of those green card holders might also have obtained a driver authorization card, meaning the blogger is counting them twice to reach his inflated figure.

Regardless of what the actual figure is – and I don’t even take this guy’s figures at face value because his reporting is so sloppy – Lauer provides absolutely no proof whatsoever that any of those individuals actually voted.  And unless they actually voted, there’s no voting fraud.

So making this wild, clickbait claim only undermines the legitimacy and credibility of real investigations of real potential voting fraud.  But back to the RJ story…

Reporter Art Kane writes that “Nevada Democratic Party communications director Molly Forgey said Trump supporters have tried everything to overturn valid election results.”

That, of course, is not true.  Trump supporters aren’t trying to overturn VALID election results.  They’re trying to overturn suspected INVALID election results, if they exist.

And while President Trump is currently trailing Joe Biden by fewer than 37,000 votes out of more than 1.3 million cast, there are a number of local races in Clark County that are a heckuva lot closer.  For example…

  • In the Laughlin Town Board election, Hermon Walker currently leads Gina Mackey by just 69 votes out of over 13,000 cast.
  • In State Senate District 6, Democrat Nicole Cannizzaro leads Republican April Becker by just 852 votes out of more than 64,000 cast.
  • In State Senate District 5, Democrat Kristee Watson leads Republican Carrie Buck by just 202 votes out of almost 64,000 cast.
  • In the county-wide Family Court Department U race, Dawn Throne leads by fewer than 7,000 votes out of 690,000 votes cast. That’s less than a 1 percent margin.
  • In the Clark County Commission C race, Democrat Ross Miller leads Republican Stavros Anthony by fewer than 600 votes out of 146,000 votes cast. That’s less than ½ of 1 percent – a razor thin margin.

So this fight isn’t just about President Trump.  And frankly, it’s not just about these particular races in this year’s fouled-up election.

This fight is about exposing all the problems caused by the rushed, last-minute changes in election law passed by Democrats in the Legislature and signed by Gov. Sisolak in August.

This fight is about making sure this assault on the integrity of Nevada’s elections NEVER happens again.

I’ll detail more of the specific problems that have been uncovered in Part III of “The Art of the (Election) Steal.”  Don’t touch that dial!

(Chuck Muth) – When President Trump and his supporters say “stop the count,” they’re NOT saying don’t count legally cast ballots.  They’re saying stop counting ballots until the ballot-counting process can be properly observed.

Big difference.

As former Soviet Union dictator Joseph Stalin famously is quoted as saying, “It’s not the people who vote that count, it’s the people who count the votes.”

One need not be a conspiratorialist to acknowledge that the new election system imposed on Nevadans by Gov. Steve Sisolak and the Democrat-controlled Legislature back in August (AB4) – just three months before a major presidential election! – is a complete mess.

The biggest problem, of course, is that ALL voters were automatically mailed ballots even if they didn’t request a mail-in absentee ballot.  That was a recipe for disaster for all kinds of reasons and everybody knew it.

Sisolak and the Democrats did it anyway.

The biggest problem is that people who should have been removed from the voter list…weren’t.

Which means ballots were mailed to people who shouldn’t have been mailed to – including a suspected 80,000 people who SHOULD have been removed from the Clark County list after the primary.  An example…

Let’s say your spouse passed away seven years ago.

And let’s say you failed to notify the Election Department – which surely happens because, let’s face it, when you lose a loved one, probably the last thing you worry about is calling the Election Department.

And why would you?  Your spouse can no longer vote, right?  After all, they’re dead.  So what’s the big deal, right?

Your deceased spouse then doesn’t vote in the next few elections.  As such, the Election Department mails your spouse a postcard, suspecting that your spouse either moved or passed away.  And if the post office returns the postcard indicating your spouse no longer lives there, then your spouse can be removed from the voter file.

But since YOU still live at the address, the postcard is delivered by the post office and not returned to the Election Department.  As such, your spouse remains on the voter file.

Which, in the “old days” before AB4, wasn’t such a potential problem.  After all, your spouse wasn’t going to show up on election day and try to vote, right?  And unless you really intended to commit voting fraud, you’re not going to request an absentee mail-in ballot on behalf of your deceased spouse.

So the potential for the dead fraudulently voting was minimal.

But under the new Sisolak System, all the dead voters who were still on the voting list were automatically mailed an unsolicited ballot.  Which made it easy and convenient for anyone willing to cast an illegal vote on behalf of a dead person.

All you do is fill out the dead person’s ballot and sign it as closely as you can to the deceased person’s signature and mail it in.  The odds of such an unscrupulous individual getting caught is practically nil.

The solution is simple: Stop automatically mailing ballots to dead people.  Duh.

And the only way to do that is to stop automatically mailing ballots to everyone UNLESS they specifically request a mail-in ballot.

So let it be written; so let it be done.

RINO Hunt Update

As I reported last week, there is an internal struggle within the Nevada Republican Assembly Caucus over The Three RINOs – Assistant Minority Leader Jill Tolles, Assistant Minority Leader Tom Roberts & Political Director Glen Leavitt – who are currently in leadership positions and ought to be replaced.

The leadership election is scheduled to take place on Friday at a caucus meeting in Las Vegas.

There are currently four members of the caucus who appear to be undecided on whether to keep The Three RINOs in their jobs or replace them with more-principled conservatives: Assemblywoman Lisa Krasner, Assemblywoman Melissa Hardy, Assemblyman Greg Hafen and Assemblywoman-elect Heidi Kasama.

(Chuck Muth) – Dear Nevada Conservatives.  I hate to break it to you, but there’s another critical election coming up next week on November 13.  As Joe Biden would say, here’s the deal…

Republicans in the Nevada State Assembly are currently in a super-minority with just 13 out of 42 seats.  But at this point in the ballot-counting, it appears the GOP is going to pick-up a net of three seats (with a fourth, AD29, still in play).

That would give Assembly Republicans either 16 or 17 seats total – meaning it would take 9 votes to elect new leaders for the Little Caucus That Couldn’t when they meet privately in a smoke-filled (or not) room next Friday.

The problem with the current leadership team is that a handful of conservative incumbent assembly members made a deal with the devil to put three RINOs (Republican in Name Only) in charge of caucus operations: Co-Assistant Leader Jill Tolles, Co-Assistant Leader Tom Roberts and Political Director Glen Leavitt.

And I’m not throwing the RINO label around willy-nilly here.  Don’t take my word for it; look at their voting records.

Here are The Three RINOs’ American Conservative Union (ACU) ratings for the 2019 session – Leavitt: 63%.  Roberts: 57%.  Tolles: 53%.

Pathetic.  As Joe  Biden would say, “Come on, man!”

Look, it’s one thing to vote like a moderate if you represent a “swing” district.  But The Three RINOs represent safe, Republican-majority districts.  There’s just no excuse for voting this badly – especially after three conservatives appear to have just won actual swing districts!

And the conservatives didn’t win those seats BECAUSE of the current leadership team, but DESPITE them. 

Indeed, the Republican Assembly Caucus refused to endorse former Assemblywoman Jill Dickman (AD31), former Assemblyman Richard McArthur (AD4) and former NPRI president Andy Matthews (AD37) in their primary races.

The caucus also refused to endorse Assemblywoman-elect Annie Black (disclaimer: one of my clients), but that’s somewhat understandable since Annie was running against Assemblyman Chris “The Weasel” Edwards, a caucus member at the time (before being crushed in the GOP primary, 61-39%).

The big problem is The Three RINOs, using the power of their leadership positions, get to control the caucus’ purse strings, candidate recruitment and campaign management, as well as the political, legislative and policy strategies during the session.

They’re also entitled to introduce more bills than non-leadership members, and have great influence over committee assignments.

The Three RINOs also control the caucus’ communications operation – which would have to improve a hundred-fold just to get to lousy.  As just one example, according to the caucus website this morning, they haven’t issued a press release since August 6!

Since that time our budget problems have gotten worse, Gov. Sisolak has continued to screw up his handling of the COVID crisis, tens of thousands of unemployment claims remain unpaid, businesses are shutting down, conventions are being cancelled, most of our kids are still locked out of their classrooms…oh, and the new mail-in general election is a complete fuster-cluck.

So it’s not like there hasn’t been plenty of grist for the mill available for the caucus’ crack (or on crack) communications operation.  Instead…the sound of silence.  Pathetic.

As the saying goes, personnel is policy.  And RINOs Tolles, Roberts and Leavitt have been an absolute disaster.  As have been the staff and consultants hired by them to (mis)manage the operation.

The entire stable needs to be mucked out.

The good news is, the caucus – with its new conservative members – have more than enough votes to oust The Three RINOs next week and usher in new, more aggressive, competent and principled leadership to guide them through the 2021 session and prepare for the 2022 election cycle.

Not counting Dr. DeLisle – since he’s currently trailing by a small margin – there will be 11 conservatives in the caucus and 5 establishment moderates.

The conservatives: Dr. Robin Titus, Jim Wheeler, John Ellison, Lisa Krasner, P.K. O’Neill (questionably), Alexis Hansen, Annie Black, Jill Dickman, Richard McArthur, Andy Matthews and Heidi Kasama (DeLisle would make 12).

The five establishment moderates: Jill Tolles, Tom Roberts, Glen Leavitt, Greg Hafen and Melissa Hardy.

So the numbers are there for conservatives oust Tolles, Roberts & Leavitt from their leadership positions, hire new, competent staff and become a true opposition party rather than a minority party, right?

Wrong.

As you know, Republicans never blow an opportunity to blow an opportunity.

Some of the conservatives appear to be, as Margaret Thatcher would say, wobbly and could side with keeping The Three RINOs in leadership positions at next week’s meeting/election.  They include Dr. Titus, Krasner, O’Neill, Hansen and Kasama.

Ugh.

As Newt Gingrich is fond of saying, real change requires REAL change.

When it comes to the Republican Assembly Caucus, that means jettisoning Tolles, Roberts and Leavitt from their leadership positions and firing their current incompetent staff and political consultants.

And if the “wobblies” can’t screw up the nerve to do the right thing next week and clean house…well, that’s what GOP primaries are for.

And I know a little bit about that.

Just ask FORMER Assemblyman James Oscarson and FORMER Assemblyman Chris Edwards.

Muth’s Truths

* If Trump loses Arizona, thank John McCain.  He again screwed the GOP, this time from his grave.

* The fouled up general election in Nevada is the direct result of the unnecessary and unwise decision back in March to allow Nevada’s primary to switch to an all-mail election. That was the camel’s nose under the tent.  Democrats took that precedent, held a special session, and changed the law for the general election despite Nevadans being assured such a drastic change was “only” for the primary.

* I don’t know who needs to hear this, but CLAIMING voting fraud has occurred and PROVING voting fraud has occurred are two different things.  If you can’t back it up, don’t make the allegation.  You’re only undermining your credibility and hurting a legitimate cause.

* If Trump loses Nevada, his campaign will have no one but itself to blame.  The Trump campaign effectively took over management control of the Nevada Republican Party and foolishly installed staffers of former Sen. Dean “Never Trump” Heller to run the show – particularly Jeremy Hughes and Keith “Schipwreck” Schipper.  Those two could screw up a two-car funeral.

* Sharing in the blame would be the Clark County Republican Party whose chairman, Dave Sadsack, supported the all-mail balloting and focused all his time fighting with the Nevada GOP chairman instead of building a local political operation in the county with about 2/3 of the voting population.

* BTW: House Speaker Nancy Pelosi really got spanked on Election Day.  Her Democrats were expected to pick up 15 seats.  Instead, as it stands right now, she lost 7.
